Motion by the appellant for leave to reargue an appeal from a judgment of the Supreme Court, Richmond County, rendered February 14, 2013, which was determined by decision and order of this Court dated January 11, 2017.
Upon the papers filed in support of the motion and the papers filed in opposition and in relation thereto, it is
ORDERED that the motion is granted to the extent that the decision and order of this Court dated January 11, 2017 [see 146 AD3d 795], is amended by deleting from the last sentence of the last paragraph thereof the word "defendant's" and substituting therefor the word "People's," and the motion is otherwise denied.
