Nadiya Gura, Appellant, v 2424 Coney Realty Corp. et al., Respondents.

Motion by respondents to dismiss an appeal from a judgment of the Civil Court of the City of New York, Kings County, entered July 12, 2016, for failure to prosecute. Separate motion by appellant for an enlargement of time to perfect the appeal.

Upon the papers filed in support of the motions and no papers filed in opposition thereto, it is

ORDERED, on the court's own motion, that respondents' motion and appellant's motion are consolidated for purposes of disposition; and it is further,

ORDERED that respondents' motion to dismiss the appeal is denied on condition the appeal be perfected by September 1, 2017; and it is further,

ORDERED that appellant's motion for an enlargement of time to perfect the appeal is denied as unnecessary; and it is further,

ORDERED that in the event the appeal is not perfected on or before September 1, 2017, the court, on its own motion, may dismiss the appeal, or respondents may move to dismiss the appeal on three days' notice, and may serve such application in person.
