| DECISION & ORDER ON MOTION |
By decision and order on motion of this Court February 14, 2017, the respondent was immediately suspended from the practice of law in the State of New York pursuant to 22 NYCRR 1240.9(a), the Grievance Committee for the Tenth Judicial District was directed to serve upon the respondent a notice of petition and a verified petition dated July 13, 2016, pursuant to 22 NYCRR 1240.8(a)(1), and the issues raised were referred to a Special Referee, to hear and report. Subsequently, the respondent filed an answer to the petition. By affirmation dated April 19, 2017, the respondent sought to resign as an attorney and counselor-at-law. The respondent was admitted to the Bar at a term of the Appellate Division of the Supreme Court in the Second Judicial Department on June 30, 1993.
On the Court's own motion, it is
ORDERED that the above-entitled disciplinary proceeding is discontinued in view of the respondent's death on June 13, 2017; and it is further,
ORDERED that the respondent's application to resign is dismissed.
