DECISION & ORDER ON MOTION

Motion by the appellant for leave to reargue his prior application for a writ of error coram nobis to vacate, on the ground of ineffective assistance of appellate counsel, a decision and order of this Court dated May 25, 2010 (People v Patterson, 73 AD3d 1215), affirming a judgment of the County Court, Dutchess County, rendered November 5, 2008. The prior application was determined by decision and order on this Court dated January 18, 2017.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that the motion is denied.
