It is Ordered that the motion and cross motion are consolidated for disposition.
It is further Ordered that defendant-appellant's motion to consolidate the appeals and to produce one record and one brief is granted, and defendant-appellant is directed to perfect its appeal by no later than the November 2017 term - the filing deadline is September 13, 2017. In the event of defendant-appellant's failure to comply with the foregoing condition, plaintiff-respondent may move, on five days' notice, for an order dismissing the consolidated appeals.
