| DECISION & ORDER ON MOTION |
Appeal by Daniel Noel and Winsome Noel from a judgment of the Supreme Court, Kings County, dated October 28, 2016. By decision and order on motion of this Court dated April 20, 2017, enforcement of the judgment and the sale, transfer, or other disposition of the subject premises were stayed pending hearing and determination of the appeal on condition that the appeal was perfected on or before May 22, 2017. The appeal has not been perfected.
Now, on the Court's own motion, it is
ORDERED that the stay granted by the decision and order on motion of this Court dated April 20, 2017, is vacated forthwith.
