Motion by respondents for leave to reargue an appeal from a final judgment of the Civil Court of the City of New York, entered April 21, 2015, and an order of the same court entered December 23, 2015, which was determined by decision and order of this court dated April 7, 2017, or, in the alternative, for leave to appeal to the Appellate Division from the decision and order of this court.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
