| DECISION & ORDER ON MOTION Motion for Poor Person Relief |
Appeal by Vincent C. Meyers from a judgment of the Supreme Court, Nassau County, rendered March 12, 2015. By decision and order of this Court dated March 22, 2017, the matter was remitted to the Supreme Court, Nassau County, for a hearing concerning certain issues regarding an item in the court file denominated "Court Exhibit # XIV," and to report to this Court limited to its findings, and the appeal was held in abeyance in the interim. The Supreme Court, Nassau County, issued a report dated May 10, 2017.
Now, on the Court's own motion, it is
ORDERED that the decision and order on motion of this Court dated August 4, 2015, which granted poor person relief to the appellant, is amended to include a direction to the court reporter to make, certify and file two transcripts of the stenographic minutes of the proceedings which occurred upon remittur before the Hon. Jerald S. Carter and resulted in the report dated May 10, 2017; and it is further,
ORDERED that the stenographer is directed to make, certify and file such transcripts within 45 days of the date of this decision and order on motion and the clerk of the trial court shall furnish one certified transcript of each of the proceedings to the appellant's assigned counsel, Patrick Megaro, 250 West Main Street, Bay Shore, N.Y. 11706, without charge (see CPL 460.70); assigned counsel is directed to turn over those transcripts to the respondent if counsel serves a supplemental appellant's brief or to turn over those transcripts to this Court if counsel informs this Court that no supplemental brief will be filed; and it is further,
ORDERED that assigned counsel is directed to serve a copy of this decision and order on motion upon the clerk of the court from which the appeal is taken.
