DECISION & ORDER ON MOTION

Motion by the petitioner for leave to reargue a proceeding pursuant to CPLR article 78 to review a determination of the Acting Commissioner of the State of New York Office for People with Developmental Disabilities, which was determined by decision and judgment of this Court dated March 29, 2017, or, in the alternative, for leave to appeal to the Court of Appeals from the decision and judgment of this Court.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that the motion is denied.
