Motion by Eric Gonzalez, Acting District Attorney, Kings County, in effect, for reconsideration of a writ of habeas corpus which was sustained in a decision and judgment of this Court dated July 7, 2017, for leave to submit opposition to the writ, and, upon reconsideration, to recall and vacate the decision and judgment dated July 7, 2017, and to dismiss the writ.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the motion is granted to the extent that the affirmation in opposition to the writ dated July 7, 2017, annexed to the motion papers is accepted for filing and deemed timely served; and it is further,
ORDERED that, upon reconsideration, the decision and judgment of this Court dated July 7, 2017, is adhered to; and it is further,
ORDERED that the motion is otherwise denied.
