ORDER ON APPLICATION

Application by Penava Mechanical Corporation on an appeal and cross appeals from an order of the Supreme Court, Queens County, dated November 23, 2016, pursuant to 22 NYCRR 670.8(d)(2), to enlarge the time to perfect the appeal.

Upon the papers filed in support of the application and no papers having been filed in opposition or in relation thereto, it is

ORDERED that the application is granted, the time of Penava Mechanical Corporation to perfect the appeal is enlarged until August 28, 2017, and the joint record or appendix on the appeal and cross appeals and the brief of Penava Mechanical Corporation shall be served and filed on or before that date; and it is further,

ORDERED that Patricia Sullivan shall serve and file her answering brief, including the points of argument on her cross appeal (see 22 NYCRR 670.8[c][3]), on or before October 2, 2017; and it is further,

ORDERED that Allen-Stevenson School and F.J. Sciame Construction Co., Inc., shall serve and file their answering brief, including the points of argument on their cross appeal (see 22 NYCRR 670.8[c][3]), on or before November 6, 2017.
