Petitioner having moved for an extension of time to file and serve a brief on this CPLR aritcle 78 proceeding transferred to this Court by an order of the Supreme Court entered in the Office of the Clerk of the County of Erie on March 9, 2017, and respondent having cross-moved to adjourn the proceeding,
Now, upon reading and filing the affirmation of Richard L. Sullivan, Esq., dated June 23, 2017, the affirmation of Allyson B. Levine, Esq., dated July 6, 2017, and the notices of motion and cross motion with proof of service thereof, and due deliberation having been had thereon,
It is hereby ORDERED that petitioner's motion is granted on the condition that the brief is filed and served on or before August 7, 2017, and the Clerk is directed to accept the brief for filing, and
It is further ORDERED that respondent's brief shall be filed and served on or before September 7, 2017, and the Clerk is directed to accept the brief for filing, and
It is further ORDERED that respondent's cross motion is granted and the proceeding is removed from the Court's day calendar for September 7, 2017, and is added to the term of this Court commencing November 27, 2017.
