DECISION & ORDER ON MOTION

Motion by the appellant for poor person relief and the assignment of counsel on an appeal to this Court from so much of an order of the County Court, Westchester County, dated November 7, 2016, as denied, without a hearing, that branch of her motion which was for relief pursuant to CPL 440.30(1-a).

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that the branches of the motion which are for leave to proceed on the original papers, for free transcripts, and waiver of the filing fee are denied as unnecessary (see 22 NYCRR 670.9[d][1][viii], 22 NYCRR 670.22[a][1]); and it is further,

ORDERED that the branch of the motion which is for the assignment of counsel is denied as academic as the appellant has retained counsel to prosecute the appeal.
