Petitioner having moved to vacate the dismissal of this CPLR article 78 proceeding transferred to this Court by an order of the Supreme Court entered in the Office of the Clerk of the County of Seneca on September 14, 2016,
Now, upon reading and filing the affidavit of Albert Fountain sworn to July 5, 2017, and the notice of motion with proof of service thereof, and due deliberation having been had thereon,
It is hereby ORDERED that the motion is granted to the extent that the ordering paragraph of the order of this Court entered February 6, 2017, is hereby amended by deleting the date April 7, 2017, and inserting in its place the date August 31, 2017.
