| DECISION & ORDER ON MOTION |
Motion by the appellant to enlarge the time to perfect an appeal from an order of the Supreme Court, Suffolk County, dated May 5, 2016. By order to show cause dated June 8, 2017, the appellant was directed to show cause before this Court why an order should or should not be made and entered dismissing the appeal on the ground that the order is neither appealable as of right nor by permission, and the appellant's motion is held in abeyance in the interim.
Now, upon the order to show cause and the papers filed in response thereto, and upon the papers filed in support of the motion and no papers having been filed in opposition or in relation thereto, it is
ORDERED that the motion to dismiss the appeal is denied (see Matter of Henry v Kelly, 86 AD2d 610); and it is further,
ORDERED that the appellant's motion is granted, and the appellant's time to perfect the appeal is enlarged until September 7, 2017.
