DECISION & ORDER ON MOTION

The People of the State of New York, Respondent, v Hector L. Ramos, Appellant.

Motion by appellant pro se, in effect, pursuant to CPL 460.30, for an extension of time to take an appeal from a judgment of conviction of the Justice Court of the Town of Poughkeepsie, Dutchess County, rendered October 17, 2016, and for an enlargement of time to perfect the appeal.

Upon the papers filed in support of the motion and no papers having been filed in opposition thereto, it is

ORDERED that the branch of the motion seeking, in effect, an extension of time to take an appeal is granted and appellant's time to file an affidavit of errors is extended 30 days from the date of this decision and order on motion; and it is further,

ORDERED that the branch of the motion seeking an enlargement of time to perfect the appeal is held in abeyance pending the filing of an affidavit of errors.

The affidavit of errors must be filed in the Justice Court.
