DECISION & ORDER ON MOTION

Motion by the respondent-appellant on an appeal and cross appeal from a money judgment of the Supreme Court, Westchester County, dated November 15, 2016, to adjudicate the appellants-respondents in contempt. Separate motion by the respondent-appellant to withdraw the prior motion and to dismiss the appeal on the ground that the joint appendix is inadequate. Application by the respondent-appellant pursuant to 22 NYCRR 670.8(d)(2) to enlarge the time to serve and file a brief.

Upon the papers filed in support of the motions and no papers having been filed in opposition or in relation thereto, and upon the papers filed in support of the application and no papers having been filed in opposition or in relation thereto, it is

ORDERED that the branch of the second motion which is to withdraw the first motion is granted and the first motion is deemed withdrawn; and it is further,

ORDERED that the second motion is otherwise denied; and it is further,

ORDERED that the application is granted, the respondent-appellant's time to serve and file its answering brief, including its points of argument on the cross appeal (see 22 NYCRR 670.8[c][3])is enlarged until September 15, 2017, and the respondent's brief shall be served and filed on or before that date.
