| DECISION & ORDER ON MOTION |
Motion by the respondent to strike stated portions of the record and the appellants' brief on appeals from an order of the Supreme Court, Richmond County, dated June 8, 2016, and a judgment of the same court entered August 12, 2016, on the ground that they contain or refer to matter dehors the record, and to enlarge the time to serve and file a brief.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the branch of the motion which is to strike stated portions of the record and the appellants' brief is granted to the extent that pages 282 through 300, 311, and 312 of the record, as well as the citation "(R.282-300)" on the second line of the third page of the appellants' brief are stricken, on or before September 7, 2017, the appellants shall remove the stricken material from the copies of the record and the appellants' brief filed with the Clerk of the Court, and that branch of the motion is otherwise denied; and it is further,
ORDERED that the branch of the motion which is to enlarge the respondent's time to serve and file a brief is granted, the respondent's time to serve and file a brief is enlarged until October 10, 2017, and the respondent's brief shall be served and filed on or before that date.
