DECISION & ORDER ON MOTION

Motion by the petitioner-respondent Forestdale, Inc., to dismiss an appeal from an order of the Family Court, Kings County, dated December 3, 2015, as untimely taken. Separate motion by Richard J. Cardinale, counsel assigned to prosecute the appeal, to be relieved of the assignment on the ground that the appellant failed to communicate with assigned counsel.

Upon the papers filed in support of the motions and the papers filed in relation thereto, it is

ORDERED that the motions are granted, the appeal is dismissed, without costs or disbursements (see CPLR 5513), and assigned counsel is relieved of the assignment.
