ORDER ON APPLICATION

Applications pursuant to 22 NYCRR 670.8(d)(2) to enlarge the time to perfect an appeal and cross appeals from an order of the Supreme Court, Suffolk County, dated January 23, 2017.

Upon the papers filed in support of the applications and the papers filed in relation thereto, it is

ORDERED that the applications are granted; and it is further,

ORDERED that the time for the County of Suffolk to perfect the appeal is enlarged until October 6, 2017, and the joint record or appendix on the appeal and cross appeals (see 22 NYCRR 670.8[c][1]) and the brief of the County of Suffolk shall be served and filed on or before that date; and it is further,

ORDERED that Kimberly Vanbourgondien and Patricia A. Vanbourgondien shall serve and file their answering brief, including the points of argument on their cross appeal, on or before November 13, 2017; and it is further,

ORDERED that Abigail L. Heins, an infant under the age of 18 years by her father and natural guardian Erick Heins, and Erick Heins, individually, shall serve and file their answering brief, including the points of argument on their cross appeal, on or before December 18, 2017.
