DECISION & ORDER ON MOTION

Motion by the appellant pro se to relieve assigned counsel and substitute purported retained counsel on an appeal from a judgment of the County Court, Nassau County, rendered November 26, 2013, and, in effect, to hold the appeal in abeyance pending determination of a motion pursuant to CPL 440.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that the branch of the motion which is to relieve assigned counsel and substitute purported retained counsel is denied without prejudice to retained counsel moving for substitution; and it is further,

ORDERED that the motion is otherwise denied.
