An appeal and cross appeal having been taken to this Court from the order of the Supreme Court, New York County, entered on or about November 2, 2016, And further appeals having been taken by plaintiffs from the orders of said Court and Justice, entered on or about November 3, 2016, February 27, 2017, June 6, 2017, and three orders entered on or about June 6, 2017, and all of the foregoing appeals having been perfected, And plaintiffs-appellants having moved for a stay of discovery proceedings pending hearing and determination of the appeals, and for a calendar preference in hearing of the appeals (M-3876), And defendant-respondent having cross-moved for dismissal of the appeals, or for an enlargement of time to file its briefs until 30 days after the cross motion is decided (M-3878), Now, upon reading and filing the papers with respect to the motion and cross motion, and due deliberation having been had thereon, It is ordered that the motion is denied, and it is further, Ordered that the cross motion is granted to the extent of adjourning the perfected appeals to the January 2018 Term, with leave to seek further adjournments, if necessary. The cross motion, to the extent it seeks dismissal of the appeal, is denied, without prejudice to further proceedings in Supreme Court, and without prejudice to said arguments being raised
