DECISION & ORDER ON MOTION

The People of the State of New York, Respondent, v Claudette Lacast, Appellant.

Appeal from a judgment of conviction of the District Court of Suffolk County, First District, rendered August 14, 2015. By decision and order on motion dated October 28, 2016, the appeal was stricken from this court's appeals calendar and general calendar, as the minutes that the District Court reviewed in determining appellant's CPL 30.30 motion had not been made part of the record on appeal. By order to show cause dated July 7, 2017, the parties were directed to show cause why the appeal should or should not be dismissed as abandoned. Separate motion by respondent to dismiss the appeal for failure to provide a complete copy of the minutes.

Upon the order to show cause, the papers filed in support of respondent's motion, and the papers filed in opposition thereto, it is

ORDERED, on the court's own motion, that the motions to dismiss the appeal are consolidated for purposes of disposition; and it is further,

ORDERED that the motions to dismiss the appeal are denied.
