v City of New York, et al., respondents.

(Matter No. 2)

(Index Nos. 707089/16, 10177/15)

DECISION & ORDER ON MOTION

Motion by the appellant to enlarge the time to perfect appeals from two orders of the Supreme Court, Queens County, dated August 30, 2016, and October 18, 2016, respectively, and to consolidate the appeals. Separate cross motions by the respondents to dismiss the appeal from the order dated October 18, 2016, on the ground that no appeal lies from an order denying reargument.

Upon the papers filed in support of the application and no papers having been filed in opposition or in relation thereto, it is

ORDERED that the motion is granted, the appellant's time to perfect the appeals is enlarged until October 11, 2017, and the record or appendix on the appeals and the appellant's brief shall be served and filed on or before that date; and it is further,

ORDERED that the cross motions are held in abeyance and referred to the panel of Justices hearing the appeals for determination upon the argument or submission thereof.

ENG, P.J., HINDS-RADIX, DUFFY and BRATHWAITE NELSON, JJ., concur.
