ORDER ON APPLICATION

Application by the appellant-respondent on appeals and cross appeals from an order of the Supreme Court, Suffolk County, dated December 8, 2016, and a judgment of the same court entered January 3, 2017, pursuant to 22 NYCRR 670.8(d)(2) for a 90-day enlargement of time to perfect the appeals.

Upon the papers filed in support of the application and the papers filed in opposition thereto, it is

ORDERED that the application is granted to the extent that the appellant-respondent's time to perfect the appeals is enlarged until October 12, 2017, the joint record or appendix on the appeals and cross appeals (see 22 NYCRR 670.8[c][1]) and the appellant-respondent's brief shall be served and filed on or before that date, and the application is otherwise denied; and it is further,

ORDERED that the respondent-appellant shall serve and file the answering brief, including the points of argument on the cross appeals, in accordance with the rules of this Court (see 22 NYCRR 670.8[c][3]).
