In the Matter of Olivier Wright, respondent,

v Kashuana Perry, appellant.

(Docket No. V-12677-13)

DECISION & ORDER ON MOTION

Motion by Kashuana Perry, inter alia, for leave to appeal to this Court from an order of the Family Court, Queens County, dated August 17, 2017, to stay enforcement of the order pending hearing and determination of the appeal, and for a preference in the calendaring of the appeal.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that the branch of the motion which is for leave to appeal is denied as unnecessary as the order is appealable as of right (see Family Ct Act § 1112), and the notice of appeal shall be served and filed in accordance with CPLR 5514(a); and it is further,

ORDERED that the branch of the motion which is for a preference in the calendaring of the appeal is denied as unnecessary (see CPLR 5521[b]); and it is further,

ORDERED that the motion is otherwise denied.

CHAMBERS, J.P., MILLER, HINDS-RADIX and DUFFY, JJ., concur.
