Application by the appellant on an appeal from an order of the Supreme Court, Nassau County, entered May 31, 2016, to substitute Allan Sasson, as executor of the estate of Jenna N. Devereaux, for the deceased respondent Jenna Deveraux, to amend the caption accordingly, and to withdraw the appeal.
Upon the papers filed in support of the application and no papers having been filed in opposition or in relation thereto, it is
ORDERED that the application is granted, Allan Sasson, as executor of the estate of Jenna N. Devereaux, is substituted for the deceased respondent Jenna Deveraux, and the caption is amended accordingly; and it is further,
ORDERED that the appeal is deemed withdrawn.
