| DECISION & ORDER ON MOTION |
Motion by the appellant on an appeal from a judgment of the Supreme Court, Dutchess County, dated July 21, 2016, for his counsel to be provided with a copy of the forensic custody evaluation marked as plaintiff's Exhibit 1 at trial.
Upon the papers filed in support of the motion and no papers having been filed in opposition or in relation thereto, it is
ORDERED that the motion is granted, and the forensic custody evaluation marked as plaintiff's Exhibit 1 at trial is unsealed to the extent that the Clerk of this Court, or her designee, may provide a copy of the forensic custody evaluation to the appellant's counsel, and counsel may review the forensic custody evaluation under the same conditions set by the Supreme Court, Dutchess County, with respect to the forensic custody evaluation; and it is further,
ORDERED that pursuant to § 670.4(a)(2) of the rules of this Court (see 22 NYCRR 670.4[a][2]), the appellant's time to perfect the appeal by causing the original papers constituting the record on the appeal to be filed in the office of the Clerk of this Court (see 22 NYCRR 670.9[d][2]) and by serving and filing the appellant's brief on the appeal is enlarged until October 19, 2017.
