DECISION & ORDER ON MOTION

Appeal by Robert Milton from an order of the Supreme Court, Queens County, dated February 24, 2017. By order to show cause dated June 30, 2017, the appellant was directed to show cause before this Court why the appeal should not be dismissed on the ground that the order dated May 1, 2017, is not appealable either by right or by permission.

Now, upon the order to show cause and no papers having been filed in response thereto, it is

ORDERED that the motion to dismiss the appeal is granted and the appeal is dismissed (see CPL 450.10, 450.15).
