| DECISION & ORDER ON MOTION |
Motion by the respondents Architectural Review Board of Village of East Hills and Board of Trustees of Village of East Hills, inter alia, to dismiss an appeal from a judgment of the Supreme Court, Nassau County, dated November 14, 2016, on the ground that it has been rendered academic.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the branch of the motion which is to dismiss the appeal on the ground that it has been rendered academic is granted; and it is further
ORDERED that the appeal is dismissed, without costs or disbursements; and it is further,
ORDERED that the motion is otherwise denied as academic.
