Appeal by Chaniece T. from an order of the Family Court, Kings County, dated February 14, 2017. By decision and order on motion of this Court dated August 2, 2017, the respondent-appellant was directed to file an affidavit or affirmation containing certain material, or move for poor person relief and for the assignment of counsel, on or before September 5, 2017. The respondent-appellant has failed to comply with the decision and order on motion of this Court dated August 2, 2017.
Now, on the Court's own motion, it is
ORDERED that the appeal is dismissed, without costs or disbursements, for failure to comply with the decision and order on motion of this Court dated August 2, 2017 (see 22 NYCRR 670.4[a][2],[4]).
