| DECISION & ORDER ON MOTION |
Motion by the respondent to enlarge until October 16, 2017, the time to serve and file a brief on an appeal from a judgment of the County Court, Dutchess County, rendered August 12, 2013.
Upon the papers filed in support of the motion and no papers having been filed in opposition or in relation thereto, it is
ORDERED that the motion is granted to the extent that the respondent's time to serve and file a brief is enlarged until October 6, 2017, the respondent's brief shall be served and filed on or before that date, and the motion is otherwise denied; and it is further,
ORDERED that the respondent's brief shall be served pursuant to CPLR 2103 (b)(1) or (3); and it is further,
ORDERED that on the Court's own motion, the reply brief shall be served and filed on or before October 12, 2017.
