ORDERED that the decision and order on motion of this Court dated September 21, 2017, in the above-entitled matter, on an appeal from an order of the Supreme Court, Dutchess County, dated December 19, 2012, is amended by deleting from the caption thereof the name "Joseph Shomo" and substituting therefor the name "Jose Shomo."
