DECISION & ORDER ON MOTION

Motion by Murray Reiss and Juliette LaBenze for leave to appeal to this Court from an order of the Supreme Court, Nassau County, dated August 7, 2017, and to stay the sale of the subject personal property, pending hearing and determination of the appeal.

Upon the papers filed in support of the motion and no papers having been filed in opposition or in relation thereto, it is

ORDERED that the branch of the appellant's motion which is for leave to appeal is denied as unnecessary as the order is appealable as of right (see CPLR 5701); and it is further,

ORDERED that the appellant may serve and file a notice of appeal from the order dated August 7, 2017, in accordance with CPLR 5514(a); and it is further,

ORDERED that the motion is otherwise denied as academic.
