The People of the State of New York, Respondent, v John J. Juback, Appellant.

Motion by appellant to vacate the dismissal on an appeal from a judgment of conviction of the Justice Court of the Town of Somers , Westchester County, rendered January 4, 2017.

Upon the papers filed in support of the motion and no papers having been filed in opposition thereto, it is

ORDERED that the motion is granted, and the court's order dismissing the appeal is vacated; and it is further

ORDERED that on the court's own motion, appellant's time to perfect the appeal is hereby enlarged and the appellant's brief shall be served and filed on or before November 20, 2017.
