| DECISION & ORDER ON MOTION |
Appeal by Michael D. Crowe from an order of the Family Court, Suffolk County, dated October 31, 2016. By decision and order on motion of this Court dated August 15, 2017, the appellant's time to comply with a scheduling order of this Court dated December 20, 2016, was extended until 30 days after the date of the decision and order on motion. The appellant has failed to comply with the scheduling order.
Now, on the Court's own motion, it is
ORDERED that the appeal is dismissed, without costs or disbursements, for failure to comply with the scheduling order dated December 20, 2016, and the decision and order on motion dated August 15, 2017, issued pursuant to § 670.4(a)(2) of the rules of this Court (22 NYCRR 670.4[a][2]).
