DECISION & ORDER ON MOTION

Proceeding pursuant to Public Officers Law § 36 to remove Christopher Anderson from the public office of Trustee of the Board of Trustees for the Incorporated Village of Mastic Beach. By order to show cause dated July 19, 2017, the parties were directed to show cause before this Court why an order should or should not be made and entered dismissing the proceeding as academic as Christopher Anderson no longer holds the public office of Trustee of the Board of Trustees for the Incorporated Village of Mastic Beach.

Now, upon the order to show cause and the papers filed in response thereto, it is

ORDERED that the motion to dismiss the proceeding is granted, and the proceeding is dismissed, without costs or disbursements (see Matter of Halsey v Butler, 134 AD3d 842).
