An appeal having been taken from a judgment of the Cayuga County Court, rendered February 24, 2015, the order of Cayuga County Court entered May 5, 2015, which denied defendant's request for forensic DNA testing of evidence pursuant to CPL 440.30 (1-a) and the order of Cayuga County Court entered May 20, 2015,
Now upon reading and filing the statement of Talib Alsaifullah dated September 28, 2017, and due deliberation having been had thereon,
It is hereby ORDERED that appellant shall file 10 copies of a pro se supplemental brief, with proof of service of one copy on assigned counsel and the People pursuant to 22 NYCRR 1000.3 (f), on or before November 9, 2017, and
It is further ORDERED that respondent shall file a brief in response to the pro se supplemental brief, if any, on or before November 24, 2017.
