| DECISION & ORDER ON MOTION |
Louis J. Aebischer, Jr., was admitted to the Bar at a term of the Appellate Division of the Supreme Court in the Second Judicial Department on June 23, 1971, under the name Louis John Aebischer, Jr. By order to show cause of this Court dated April 6, 2017, Mr. Aebischer was directed to show cause why discipline should or should not be imposed upon him in this State pursuant to 22 NYCRR 1240.13, based on the misconduct underlying the discipline imposed upon him by an order of the Virginia State Bar Disciplinary Board, entered March 7, 1997. By opinion and order of this Court dated August 2, 2017, Mr. Aebischer was disbarred from the practice of law and his name is stricken from the roll of attorneys and counselors-at-law.
On the Court's own motion, it is
ORDERED that the opinion and order of this Court dated August 2, 2017, is recalled and vacated, and the above-entitled disciplinary proceeding is discontinued, in view of the death of Louis John Aebischer, Jr., on May 4, 2017.
