DECISION & ORDER ON MOTION

Motion by the appellant to withdraw the brief filed by assigned counsel on an appeal from a judgment of the County Court, Suffolk County, rendered March 11, 2016, and for leave to serve and file a replacement brief. Separate motion by the appellant pro se for leave to serve and file a supplemental brief.

Upon the papers filed in support of the motions and the papers filed in relation thereto, it is

ORDERED that the motion to withdraw the brief filed by assigned counsel and for leave to serve and file a replacement brief is granted, the brief filed by the appellant's assigned counsel is stricken, and on or before November 15, 2017, the appellant's assigned counsel shall serve and file a replacement brief; and it is further,

ORDERED that the motion for leave to serve and file a supplemental brief is denied without prejudice to renew after assigned counsel serves and files a replacement brief; and it is further,

ORDERED that on the Court's own motion, the respondent's time to serve and file a brief is enlarged until December 15, 2017, and the respondent's brief, if any, shall be served and filed on or before that date.
