| DECISION & ORDER ON MOTION |
Application by respondents-appellants Two-Twenty Records Management, LLC, and Leigh Randall, pursuant to 22 NYCRR 670.8(d)(2) to enlarge the time to perfect their cross appeal from an order of the Supreme Court, Westchester County, dated March 22, 2017. Separate application by respondents-appellants Gotham Private Equity Partners, LP, AUA Private Equity Partners, LLC, and Topspin Partners, LLC, to perfect their cross appeal from the order.
Upon the papers filed in support of the applications and no papers having been filed in opposition or in relation thereto, it is
ORDERED that on the Court's own motion, the appeal by the plaintiff is dismissed, without costs or disbursements, for failure to perfect in accordance with the rules of this Court (see 22 NYCRR 670.8[e]); and it is further,
ORDERED that the applications are granted, the applicants' time to perfect their appeals is enlarged until December 26, 2017, and the joint record or appendix on the appeals and the applicants' briefs shall be served and filed on or before that date.
