DECISION & ORDER ON MOTION

Motion by Raelene O. Birkett for leave to appeal to this Court from two orders of the Family Court, Nassau County, dated September 19, 2017, and September 22, 2017, respectively, to return the subject children to his care and custody, pending hearing and determination of the appeals, and to consolidate the appeals.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that the branch of the motion which is for leave to appeal is denied; and it is further,

ORDERED that on the Court's own motion, the appeals purportedly taken as of right are dismissed, without costs or disbursements; and it is further,

ORDERED that the motion is otherwise denied as academic.
