It is ordered that the defendant-appellant's motion is granted t the extent of dismissing the appeal because of the defendant-appellant's death on June 21, 2013, and remanding the matter to the Criminal court of the City of new York, New York county, for proceedings to acate the judgment of conviction and to dismiss the accusatory instrument.
