| DECISION & ORDER ON MOTION FOR REINSTATEMENT |
Motion by Lung-Fong Chen for reinstatement to the Bar as an attorney and counselor-at-law. Mr. Chen was admitted to the Bar at a term of the Appellate Division of the Supreme Court in the Second Judicial Department on November 14, 1979. By decision and order on motion of this Court dated December 4, 2001, Mr. Chen was immediately suspended from the practice of law as a result of being found guilty of a serious crime, pending further order of the Court, pursuant to Judiciary Law § 90(4)(f), and he was directed to immediately apprise the court of his sentencing. By opinion and order of this Court dated October 7, 2002, Mr. Chen was disbarred based on his conviction of a felony and his name was stricken from the roll of attorneys and counselors-at-law. By decision and order on motion of this Court dated April 8, 2011, Mr. Chen's motion for reinstatement was held in abeyance and the matter was referred to the Committee on Character and Fitness to investigate and report on Mr. Chen's current fitness to be an attorney
Upon the papers filed in support of the motion and the papers filed in relation thereto, and upon the report of the Committee on Character and Fitness and the exhibits annexed thereto, it is
ORDERED that the motion is denied.
We find that Lung-Fong Chen does not demonstrate the requisite character and fitness to practice law.
