DECISION & ORDER ON MOTION

Motion by appellant for a stay pending the determination of an appeal from an order of the Civil Court of the City of New York, Kings County, entered June 1, 2017.
Upon the papers filed in support of the motion and no papers having been filed in opposition thereto, it is
ORDERED, on the court's own motion, that appellant's notice of appeal from the order entered June 1, 2017 is deemed to be an application for leave to appeal from that order and leave to appeal is granted (see CCA 1702 [c]); and it is further,
ORDERED that appellant's motion for a stay is granted on condition that the appeal be perfected on or before January 5, 2018; and it is further,
ORDERED that in the event that the above condition is not met, the court, on its own motion, may vacate the stay, or respondent may move to vacate the stay on three days' notice.
