| DECISION & ORDER ON MOTION |
Motion by the appellant on an appeal from an order of the Supreme Court, Nassau County, dated September 25, 2015, inter alia, to stay the sale of the subject premises and, in effect, to stay enforcement of a judgment of the same court also dated September 25, 2015, pending hearing and determination of the appeal. Separate motion by the appellant to enlarge the time to perfect the appeal.
Upon the papers filed in support of the motions and the papers filed in opposition thereto, it is
ORDERED that on the Court's own motion, the notice of appeal from the order is deemed to be a notice of appeal from the judgment (see CPLR 5512[a]); and it is further,
ORDERED that the motion, inter alia, to stay the sale of the subject premises is denied; and it is further,
ORDERED that the motion to enlarge the time to perfect the appeal is granted, the appellant's time to perfect the appeal is enlarged until December 4, 2017, and the record or appendix on the appeal and the appellant's brief shall be served and filed on or before that date.
