Defendant having moved for an order amending the notice of appeal and the order of assignment (M-677), entered on April 7, 2017, which deemed the moving papers a timely filed notice of appeal and granted poor person relief in the appeal taken from the judgment of the Supreme Court, Bronx County, rendered on or about February 9, 2016, under Ind. No. 3315/14. Defendant seeks to amend the order to include an appeal from a judgment of the same Court also rendered on February 9, 2016 under Ind. No. 3224/14, or in the alternative, for permission to file a late notice of appeal under said indictment, Now, upon reading and filing the papers with respect to the motion, and due deliberation having been had thereon,It is ordered that the motion is denied.
