Appeal from an order of the Civil Court of the City of New York, Queens County, entered May 5, 2016. The order denied appellant's motion to dismiss the complaint.

ORDERED that the appeal is dismissed, as, subsequent to the order appealed from, the matter proceeded to inquest following appellant's failure to appear for trial (see Livny v Rotella, 305 AD2d 377 [2003]).
