DECISION & ORDER ON MOTION

Motion by the respondent to dismiss an appeal from an order of the Supreme Court, Suffolk County, dated August 31, 2016, on the ground that the appellant's appendix is inadequate.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that the motion is denied on condition that on or before December 18, 2017, the appellant serve and file a supplemental appellant's appendix containing the notice of cross motion dated January 9, 2017, any exhibits annexed to the affirmations and affidavits contained in the appellant's appendix, and the transcript of the proceedings which occurred on November 19, 2014; and it is further,

ORDERED that on the Court's own motion, the respondent's time to serve and file a brief is enlarged until January 17, 2018, and the respondent's brief, if any, shall be served and filed on or before that date.
