An appeal having been taken from an order of the Supreme Court, New York County, entered on or about June 20, 2017 And defendant-appellant having moved for relief in the nature of a temporary restraining order and injunction, precluding plaintiff from transferring, encumbering, dissipating or permitting to become subject to a security interest or lien a certain property, pending hearing and determination of the aforesaid appeal, And an interim stay having been granted by a Justice of this Court on September 29, 2017, Now, upon reading and filing the papers with respect to the motion, and due deliberation having been had thereon, It is ordered that the motion is denied and the interim relief granted by an order of a Justice of this Court, dated September 29, 2017, is hereby vacated.
